Chasing The Devil In The Details

‘3 people can keep a secret if 2 are dead’

While thinking about the case, as I often do, I saw this grim proverb etched across the back of a hoodie. It’s owner, a motorcycle rider, was weaving in and out of traffic on the 15 freeway in Corona. At first glance I was silently amused but it had a sobering effect as well. It made me think about secrets. What one must go through to hide terrible secrets, secrets such as theft and murder. The many, many lies one must tell. For years.

Here is a digital recap of the events that occurred on February 4 2010.

Free Parking

As a family with children of varying ages and a full life, my wife and I are always on the go. Work, school, shopping, karate, Girl Scouts, Color Guard, gymnastics, meetings, church, more meetings, more shopping or just running out for ice cream. That last bit is my own guilty pleasure. Of course, we are a two car family. Sometimes we even have to take two cars to the same events. Mrs. Cornelius and I share an equal balance of running to and fro. Regardless, I purposely would leave the spot in the driveway closest to the front door for her to park so that her and the kids could get in and out quicker. Unloading groceries would also be easier. It was just always that way.

I was listening to a true crime podcast recently, and as I tend to do, I related some of the details discussed to the McStay case. In this such case, the Walker Family murders from 1959, the subject came up about the specific vehicle parking of the victims. My thoughts began to drift to the Trooper, the vehicle in the surveillance video, the Dodge truck……and that afternoon.

Ross

We know that Joseph was out meeting Chase Merritt in Rancho Cucamonga at around 1pm that afternoon. We have no account for when Summer left the house for her shopping trip to the Ross store in Vista but there is the charge to her card at 2:36. The next activity assumedly by Summer herself is on the home computer for Craigslist children’s toys at 3:52. Next at 4:25, a phone call is placed from the home phone to Joseph’s phone. Inexplicably this call is missing from Joseph’s phone log.  This call info comes from early media reports who got it directly from LE. However there is a voicemail retrieval at 4:27 from Joseph’s phone. It’s 4 minutes long. Would Summer leave a 4 minute voicemail and why would she be using a landline?  Curiously, throughout the entire phone log there is not another call to Joseph’s phone from the house. Next a text is sent from Summer’s phone to Joseph’s at 5:05. Joseph didn’t respond to either the phone call or text.

The 4:25 call to Joseph could have been Summer calling Joseph to tell him she was going out to purchase or look at some toys, or even just to run an errand. We don’t know the duration of the call or if it’s even related to the voicemail.

Could Chase have gained control of Joseph as soon as 3 PM?

Mcstay dodge truck

Looking at the parked Dodge truck it would appear that it is parked specifically for two vehicles to fit. Many have speculated that it wouldn’t be enough room for another vehicle to fit but I can attest that is. But more to the truck here in particular, I believe it was parked on the left not because it was Summer’s ‘spot’ but because there was another vehicle already parked in the driveway, and not the Trooper.

I imagine Summer pulling up to the house like she had a hundred times before and saw some vehicle parked in the driveway, on the right side. One she may have been familiar with. Maybe this seems way off. I can’t get over the feeling that there possibly was another vehicle there when Summer came home. The fact that what appears to have been Merritt’s truck exiting the driveway that evening is equally troubling.

Did Merritt (or whomever) pull into the driveway because the right side was open?

And where exactly was the Isuzu Trooper?

If Joseph made it home that afternoon, why not pull into the driveway if Summer actually did leave that side of the driveway open?

Could there have been a second perpetrator working in tandem with Merritt?

The Voicemail Thing

There was a voicemail retrieval at 12:11 that afternoon and it was 4 minutes as well. So, at 4:27 was someone (not Joseph?) listening and deleting that voicemail? There was another at 4:31 for 2 minutes. By assumption, Joseph and Chase were to have parted ways by 3 that afternoon. So where was Joseph at 4:27? Where was Chase? By Chase’s own recollection, he could not remember anything after 5PM.

Maybe this is when things really began to go awry.

You might think, these calls and voicemail seem trivial, why is any of this important? As someone suggested, perhaps the 4:25 is not listed on the phone log because the call was dropped or Joseph’s phone was dead. And maybe the 4 minute voicemail was from Summer. That’s totally possible. But to back up a little bit, Joseph’s phone receives a call from Chase at 4:18. It lasts 3 minutes. That puts the time at 4:21. The house call is made at 4:25 to Joseph. The voicemail is next checked at 4:27 for 4 minutes. Then again at 4:31 for 2 minutes (4:25-27). The 4 minute VM could be the same one from that day at 12:11, and the 2 minute VM is from Summer.

Why would Joseph need to listen to a 4 minute VM that he already listened to?  Why would Summer leave a 2 minute long VM? Why wasn’t he calling her back and responding? Summer sent Joseph two texts at 5:05. Was she worried? Should she have been? Of course, the VM may have not been exactly 2 minutes but at least 1 minute. Still, the other VM was listened to first. Why would he listen to it before Summer’s? For this phone I wonder if voicemails stack up with the oldest being first, or the last message left being first? On my current phone it lists the last first in the que.

One other explanation. The 4 minute VM was left after someone called and the call dropped, like with Summer’s attempt. So the number for that caller, like Summer’s, would be absent from the phone record.  But again, who would leave a 4 minute VM?

17037 Brookhurst st, Fountain Valley, Ca

Mcstay Dental office

Could the VM be connected to the mysterious Google search for an address of a dental office done at the McStay residence on February 8th? Would the time of this search coincide with Merritt’s radio silence that day? 2 weeks prior, Joseph had placed a 3 minute call to this office. Immediately after that call Joseph called Merritt twice.

With the family presumably buried, was there another loose end Chase Merritt needed to take care of on top of staging the Trooper and cancelling Quickbooks? What would be the importance of looking up this address? I’m curious to know if the number to the dental office is on Merritt’s phone records as well. Why was the address search done at all? Considering that the search was done within the home, the address was probably there as well. An address would typically be found on a letterhead or in one’s records. Or, on a bill.

Out On A Limb

We know a lot from what has come out in the media and from witness testimony. Despite that, there is a lot we don’t know. As of this writing there are motions to exclude evidence, before the trial is even underway. There are still many warrants that are sealed.

We really have no idea how things transpired on the afternoon of February 4th. But we have Chase Merritt’s recollection of things. Even that has been conflicting as he has given different reports. We have all these pings between Rancho Cucamonga and Fallbrook. We can assume Joseph did meet Chase for lunch at least round 1PM. The 2 hours of radio silence after that has me bothered because I can’t see them – or anyone – sitting in a Chick-fil-a restaurant that long. One hour tops. Maybe they went back to the warehouse. This is also something Chase had told to some people, but not detectives. It’s curious.

Maybe they went to Chase’s apartment. There was something that Chase had told detectives in one of his interviews that led me to believe he and Javis did not share an apartment but I could be wrong. Or he was caught in a lie within a lie. We haven’t seen all the warrants but I do wonder if all these areas were searched. I can’t imagine they wouldn’t have been.

So what became of Joseph after their lunch? Did he simply go home? Why did he only call Chase? From the beginning, what has always bothered me was that electrical cord around Joseph’s neck. It doesn’t sound like it was used as a means of strangulation, but of restraining. To exude dominion and control. Or to keep Joseph quiet if he was being held somewhere. It could have also been used to torture.

Joseph could have very well been overcome by Chase while meeting him after lunch. This theory is nothing new and has been floating around since Chase’s arrest, so I’m not proposing anything new there. In fact Joseph’s father Patrick has suggested this in his latest interview. I don’t agree a lot with what is said here but I do think there is a plausible scenario that Joseph did not make it home in the way we think he did.

LE contends all of the family  members were murdered in the home because of items found in the graves. This could very well be. We know about the material wrapped around Joseph is suggested to have been the futon cover. If it is the cover, it may have been used to hold or cover other things or victims before being used on Joseph. I have expressed belief in the past that Joseph may have been kept alive longer than the others, perhaps much longer, because of the condition his remains were found. Because Joseph was buried with this material around him, it doesn’t necessarily mean that he left the house in the same manner. But why weren’t the other family members wrapped in a similar way?

There is no proof that Joseph made it to Fallbrook, only that his phone did. Merritt never called Joseph after their meeting. If Joseph was done with Merritt, or fired him, why was he still calling him?

It has been long theorized that it was Chase making the 8:27 call from Joseph’s phone to his phone. The suggestion is that Chase was trying to show some proof of life, or that Joseph was okay at this point on the night of the 4th, with his phone pinging in Fallbrook. If we entertain this possibility, is it not to far fetched to believe that Chase had Joseph’s phone all along, calling his own phone maybe even as early as 3 PM. Because of this, Chase could have listened to the last voicemails as well as read any texts. Chase may have decided then he needed to tie up some loose ends, and quick.

I know that the ping info on this makes this theory problematic. Because when Joseph’s phone is calling Merritt’s it pings in Fallbrook while Merritt’s pings in or near Rancho Cucamonga. But Merritt doesn’t need to be with his phone and answering it for it to ping.

There may be something more to that last left voicemail, and not the one from Summer.  I do think it could play a very significant part in all of this, maybe something virtually everyone missed.

Chase Merritt is a very calculated individual.

DNA

Merritt’s DNA was not on the Trooper door handle. In the last installed segment of another documentary, Merritt’s lawyer Maline makes this claim. One theory that is being floated about is that Merritt’s DNA ended up in the Trooper through Touch DNA. This can happen through a simple handshake and skin cells are left behind. I have to ask though, was it not Merritt’s DNA there or no DNA? If Merritt’s DNA was in the other areas by way of transfer, shouldn’t it be on the door handle as well? Could it have been removed by wiping down the handle? Let’s consider this logically. Regardless that there was nothing on the door handle, Merritt’s DNA was elsewhere they shouldn’t have been for someone who claims he’s never once driven the vehicle.

However, if we consider the possibility that Merritt’s DNA ended up in these places as secondary transfer, it should be on the door handle and door. According to Maline it’s not. Also no one else’s DNA is on these other places aside from Joseph’s and Summer’s. Did Joseph and Summer drive it to the border? How is it Merritt’s DNA ends up on the gear shift if he never drove it? Shouldn’t there be someone else’s DNA there if Merritt didn’t drive it?

Merritt’s defense attorney’s are attempting to get the Quickbooks evidence thrown out. I’m confident they won’t succeed but you never know with this legal stuff. If they do succeed, the state going forward may have quite a challenge ahead.

  1. Interesting post Corn. Hopefully most of these questions will be answered. Surely investigators must have found some proof of Joseph’s actual presence in and around Fallbrook beyond just cellphone pings?
An eye witness or a credit/debit card purchase?
If Merritt was wearing gloves while driving the trooper his dna may have been transferred to the wheel and gearshift from his clothes or from him rubbing sweat from his face with gloved hands. He may have just closed the trooper door with his hip.
I just watched a House Hunter Renovation episode of a young family in southern California that reminded me very much of the McStays. What happened to the McStays is horrific, heartbreaking, evil, almost beyond belief really especially the whole horrible RB aspect.
I believe we don’t know half of the evidence that LE has against Merritt. When the prosecution lays it all out there won’t be a shadow of a doubt about his guilt.
    Justice is coming.

    • I have to acknowledge the theory of Joseph being attacked before making it home or him not making it home at all has its flaws. There has been a rumor that has been around from the beginning that Joseph stopped at a safe deposit box in Temecula on his way home. Supposedly LE knew of it but was never able to locate it. This is impossible to verify though. If we go by the ping info for Joseph’s phone he may have taken as long as 3 hours to get home. That’s more than twice the time it should have taken. He never called anyone but Chase. He didn’t call or text Summer back. There’s so many anomalies that occurred between the 4-8th. Joseph’s phone pinged from Rancho Cucamonga to Fallbrook. Neither Summer’s or Joseph’s phone pinged beyond Fallbrook and have never been located. The disappearance of the phones and recovery of one of the covers is quite telling. It seems premeditated and very calculated.

      • I’m unable to locate where to post so I’m replyjng to your post. I hope you don’t mind. The address that was searched from the Mcstay computer on February 8th has a dentist office at that location but it also has a T Mobil store. Thanks

        • Yes I’m aware of this, it’s in the same warrant that discusses the address search. They stated they contacted t-mobile’s loss prevention for surveillance video. They also state that the address is also an EIP client. Impossible to know now if that client had been interviewed. That could be part of the sealed warrants.

      • The phone cover thing has always bothered me…was it only Summers phone case that was found?

why would the killer or killers throw in the phone case but not the phone? You’d think they’d just either stomp on the phone with the case to bust it up or bend it so it snaps or even just toss it somewhere no one would think to look for it. do you think the phones are still out there, waiting to be found?

        • It’s not known who’s phone case it was. Chase would know though, he has all the answers. My guess is he held onto the phones in an attempt to get through to emails or other things.

  2. Hey Corn! It’s the stranger from the Land of Enchantment. I still can’t log into blog to leave a comment with the password, so I thought I would share here. Have patience while reading this. Regarding Touch DNA-If Joseph and Merritt shook hands when they met at the restaurant, would there still be enough DNA to transfer to the gear shift if Joseph ate? Wouldn’t that DNA be wiped off on a napkin, soda cup, sandwich wrapper, etc? Even if he didn’t eat, surely Joseph would of at least got a drink. If Joseph terminated their working relationship, I can’t see them shaking hands after the fact. Someone firing my ass would not get a hand shake. I see Merritt being a @ick and not ending things on good terms. Now, if the meeting was a positive regarding a new contract, then there would be hand shaking going on before and after lunch. so yes DNA could be found in the gear shift, but why not on the door handle? I may be far left on this, so disregard if that’s the case. I know nothing about DNA evidence except what I learn in TV. Tell Fran and the others Hey, Hey, Hey! .b.

    • This is also something that may not be true but the rumor is that after the lunch Joseph and Chase went back to the warehouse/workshop. Maybe Chase incapacitated Joseph at that location and then Chase went to Fallbrook by himself with Joseph’s phone on his person and surprised Summer and the boys. Maybe just more speculation from armchair detectives that took over Baker’s blog and spread false ideas and just crap.

  4. It has been so many years, maybe this has been shot down and put to rest as just speculation, but here goes: Guy Joseph’s mom has a home in Fallbrook about two miles from the McStays Rancho Viejo home. Supposedly that is how Joseph discovered the area. Speculation is that Joseph stopped at Costco in Temecula and purchased a laptop for Guy Joseph. He then went to Guy’s mom’s house and met up with Guy and stayed awhile and visited with him before Joseph went home on the 4th. Maybe Chase was at the home first with Summer and the boys. This is from Baker’s blog so I feel it may not be true at all but may be worth discussing if there is some other info that might make this situation plausible.

    • Leave it to good ol’ Rick to bend the truth. I’m looking at the actual shipping document. Joseph purchased the laptop from Costco on February 1, it shipped out on the 3rd. Joseph received notification at 3:44 AM on Feb 4 that it shipped. Guy received it on the 8th.

  5. Wow! Rick Baker is still at it. The link for the estate sale shows all these really nice items and Rick states he would not disrespect Becky by bargaining. Yet in his blog from Becky’s foundation (see Feb 2017), he states he could never bring himself to sell Becky’s items and so therefore gave ALL, EVERYTHING of Becky’s possessions to the Salvation Army. It can’t be both Rick. I was actually starting to feel a little sorry for him. Thought maybe he really did have some regret on how he treated the McStays. But Nope-not now

    • Did you see the update? LOL. You’d thought it was an estate sale for Elvis Presley’s belongings. I seriously doubt anyone outside her family or friends is going to remember that dish set they picked up for cheap belonged to Becky…more likely some guy who couldn’t quit promoting himself.

  6. And after all this time, Rick finally admits he is cancerous to those around him.

“As I look back, I now see that Becky knew she was sick four years before she passed away. She was afraid to address the lump and just hoped it would go away. The signs were there for me, but I was too wrapped up in other “important” stuff to see it.

I had written a book about a missing Southern California family, the McStays, that had begun to consume me (and therefore, Becky). It was a controversial book that took off in the online crime forums. Soon, I authored a blog that had many thousands of hits every week and hundreds of comments each month. I began to believe “my own press” that screamed how “important” I was to the case.” I was an expert, who needed to be involved. The blog, the media interviews, and my ego soon began to take over. I spent many hours daily trying to find the family, traveled extensively in search of the Mcstays and ran down every lead I received. Becky seemed to enjoy the ride as well, but I now think that she just wanted me to be happy and fulfilled, and so she supported my meaningless efforts. A love I could have never deserved.

I said and wrote things about people I never should have. I had become toxic. I look back now and see a man I do not know. I will forever be disappointed that I ever wrote the book. Thankfully, it is no longer available for purchase. The time I wasted that could have been spent solely with Becky. I was so blind.”

    • This is probably a CYA ploy for when he meets another woman. His internet history run make any normal woman run for the hills. He can’t erase everything on the net, but he sure can make up some stories in advance about his past nasty behavior. I also noticed Rick G Baker .com has been updated. Not sure of the purpose, other than to advertised his telephone number. I was reminded of the movie, Harvey, where Jimmy Stewart has these social calling cards he hands out to people.

Wasn’t it found out that RB’s MIL actually owns the house he’s living in?

No doubt her dogs miss her, unless they too will be re-homed.

    • The MIL deeded it over to him shortly after Becky died. Then in Oct 2017 he transferred the deed over to The Becky Foundation (still himself really). I’m sure there was some financial/tax angle to that move. I haven’t spotted any signs online of the house being for sale or rent yet.

He might genuinely care about those dogs. I noticed he foot the bill for one of them to have some sort of medical procedure. Of course, it all depends on if they begin to cramp his style. Right now, I think they fit in with his look at me personality. Fluffy white dogs in my nice truck. If he is entertaining ideas of moving out of that house he is going to need another house with a large yard for all those big dogs.

  8. I think he sincerely loves the dogs. He is probably just making room for a potential roommate or two. There really is a ton of stuff for sale. Maybe I am wrong because he does not seem to stay very long in one place. Kind of a nomad type of person.

    • I would not doubt that she did set things up for her dogs. They were her children. She was a kind soul and hooked up with Baker. I am sure he loves the dogs and maybe he has changed with facing the facts that she has died. As an ex-reverend he is not very empathetic. I wouldn’t be surprised if her mom is not the executor of a trust for the dogs. Baker said on the foundation blog that Becky saved everything from her first husband after his death and he said that Bob was her first love. He was happy to always be second. Yeah, right. I do not believe that at all. There were hundreds of boxes with all his clothes, shoes and books. He probably shipped all that stuff off to Bob’s family. I wonder if he heard from his kids on Father’s day? Still waiting for the ax of doom to come down on his head.

This man has been suspected as being the Zodiac because his appearance is similar to that of sketches. After learning about the identity of this man, the dates and places he’s been, it’s possible there is a connection. In 1965 he lived in Richmond, Ca which is in extreme proximity to the Zodiac murders that began in 1968. It’s still not known why Nichols chose to disappear and assume another identity so many decades ago. I can’t but notice the similar neat writing. Although Nichols wrote in block lettering and Zodiac was lowercase.

Maybe he will write another self published horrendous book about losing his wife and surviving another tragedy. He wrote about his relationship with God, wrote about the ex-girlfriend and all that hate involving his two kids with her, more to come, just wait.

Becky’s cancer treatments – Yes, she had them – probably drained a good chunk of her money. It may have even been the driving force behind his foundation. How sad and pathetic is that.

    • That’s exactly what I was thinking, Mega! There’s no way in hell I’d quietly sit in jail for a crime I did not commit. I would be screaming my innocence to everyone, giving interviews to MSM and firing my attorneys for dragging their feet.

        • I wouldn’t go as far as to say they (detectives) believed she was raped but rather were exploring the possibility. And of course if Merritt’s DNA was found where it shouldn’t be, then it’s just more damning evidence against him.

I don’t think i would call McGee a creep though, He is a former deputy district attorney and prosecuted cases on behalf of the County of San Bernardino for over twelve years. anyway what if Merritt’s DNA is not there? I am anxious to see how this all plays out.

It is beyond time for justice for this family. The prosecutors most likely have a ton of evidence to keep Chase in jail for all these years with no bail while his attorneys try to come up with more crap to spin this crime. Chase’s attorneys are creeps themselves.

They contacted Evans and he said Lepik was his dad. The other son, Tommy, told me that. Remember he posted on this blog. I actually called and talked to him. He did not know who Evans killed. I wish I could find that out. I believe his name was Michael Evans. I need to check my notes for sure.

        • ABC: His name is Michael James Evans. He lived with Jim in Aurora, Co. He was arrested in TX on July 23-2005 for murder. I don’t know if he had a trial or what. He did not get the death penalty because his release date is 7-22-2040. Maybe he took a plea to avoid the death penalty. When Tommy first told me about him back in May I looked Evans up at the TX criminal site. Jim’s body was found on 6-25-2005. I wonder if Michael went after someone for his dad’s death. Michael was also in prison in CO for drugs at one time. Probably at the same time as Jim.

  13. How old is he? A couple of people with that name seem young – as in their 30s, so all these crimes would have been committed while in their 20s.

    • I don’t know his age for sure. I think he is in his late 40’s. The one criminal site in CO said he was from Pueblo, CO. Jim’s family is from there. I assumed he is Jim’s oldest son. When I knew Jim I did not even know he had any kids. He lived with Jill and her daughter and they were married for many years. Michael turned over Jim’s ashes to Jill. Tommy said that he wanted that gold lion necklace that his dad always wore.

  14. That’s not the same Michael Evans that is in prison for murder. He’s too old and is in the Tarrant County jail. Jim would have been 14 when that man was born. I finally found the murder case against the 36 year old Michael Evans with the 35 year sentence for murder. But I’m still not 100% certain he is Jim’s son, this article states he was living in Lufkin, TX (not Colorado) – yet it was a double murder over a drug deal. More than likely him though.

I bet you are right about this Michael Evans being Jim’s son with the drug activity. Still wondering what evidence is out there that Wali killed Jim. Maybe it was more than just one person.

      • Did you find Davidson obit? He worked in a hospital as ct/mri/ xray tech. Evans was a land surveyor and Jett was in the military. All good professions. Why were they are involved in this seedy drug business? All of them addicts?

        Like

        • Good question. I can only think that it was because of big money. If Jim was cooking the meth he most likely was a big supplier. Davidson and Jett could have been distributors. From reading about these kind of drug happenings, some of the suppliers and distributors do not take the drugs. Jim turned into an addict. Maybe these other two were not or they might have been at one time and cleaned it up but still could not resist the money. When I talked to Tommy he kept going on and on about his dad having money when he was killed. He wanted to know where it all went. He thought Jill took it all somehow. Jim had three sports cars and a BMW. I called Tommy back and left a message but he still has never called me. I think his sister told him not to get involved with this crime and keep his mouth shut.

Do you believe that? I’ve never known hardcore addicts to have any money (other than the filthy rich & celebrities). Then add in that he spent time in prison right before he was murdered. He sure didn’t own any property. Unless Tommy saw those cars, I don’t know that I would believe they existed. If he died with assets and without a will it would have gone through probate and those kids would have been notified….not Jill since she was no longer married to him.

One thing I’ve noticed since you first brought up Jim, most of the people we’ve searched all have a connection to Texas. And the way that article portrays how casually Evans shot those 2 men, I wouldn’t be surprised if that circle of people had other bodies on them.

    • I have to agree. One shot to the head each. Sounds like execution style. I did not find an obit for Harry Davidson. Jim’s brother is 73 and lives in an apartment in Pueblo. Kenneth Lepik. His daughter Cindy Lepik died age 48 in 2015. I do not know her cause of death. She lived in Colorado Springs. Jim probably boasted about his wealth to Tommy, my guess. Tommy said that Jill called him and told him his dad was dead and there was no money or property to divide up. Obviously he did not believe her.

Terrie and Brent Stalsby of Lufkin announce the birth of their daughter, Stormee Shyann, born Feb. 27 at Memorial Medical Center, weighing 7 lbs. 6 oz. Sister is Jazmyn Elayne Stalsby. Grandparents are Elaine Rushing and Richard McCarty, both of Lufkin. Great-grandparents are Joyce Taylor and Kent Taylor, both of Lufkin.

Flashforward to a 2011 sentencing hearing for a 2007 double murder.

Lufkin couple sentenced for role in Aryan Brotherhood murders
Brent Stalsby, 30, pleaded guilty on Jan. 21, 2011 to committing a violent crime in aid of racketeering activity, (VICAR) and was sentenced to life in federal prison by U.S. District Judge Marcia Crone. Specifically, Brent Stalsby admitted that he murdered David Mitchamore and Christy Rochelle Brown. Terry Stalsby, 29, pleaded guilty on Jan. 21, 2011 to charges of accessory after the fact in the murder of Christy Rochelle Brown and was sentenced to 162 months in federal prison today by Judge Crone.

The Michael Evans born in 1969 could be possible. Jim had just graduated from high school in 1969. Like you said, with this crew maybe the murder Michael Evans committed is a cold case and he has not been arrested yet and Tommy said he killed someone and was spilling the family beans. Maybe that is why I have not heard from him. He might have had second thoughts about disclosing info.

What family beans? Jim was murdered 14 years ago. I’m not sure the Evans in the TX DOC is Jim’s kid. His mother sure got around (AL,LA,SC,TX) and with various men, but I find no link to Colorado or Jim. The daughter who was arrested used the last name Evans too before she married the KKK guy. And damn if I can figure out who Daddy Evans is. Those two were born in 1981 & 1982…wasn’t Jim married to Jill around that time? He married a Susan Green in 1975 and there was a prior marriage in NM to a Diane (not sure of her maiden name).

Oh well, it was an fascinating search of bad guys. If you’re interested I found a couple of recent pics where Elaine visited her murdering children in prison.

The phone call on her show can not be verified but here is the link: https://www.usmagazine.com/celebrity-news/news/ashleigh-banfield-interviews-man-claiming-to-be-chris-watts-gay-lover/ It has also come out that more recently Watts was having an affair with a co-worker. This was a woman that was a field engineer. He is supposedly in an affair with her up until the day that he was fired from his job. They worked together and her dad was Watt’s boss. That is why he was fired so quickly when he got arrested. The guy is a true creep.

Now killing or disappearing just the wife, seems they stand better odds of not being arrested and convicted. I can think of a lot of cold case missing or murdered wife cases, where everyone thinks the husband did it. Maybe that’s why Chase ran free for so long, highly unusual for someone other than a family member to poof an entire family. Which is probably why so many internet people were so accepting of the lies Baker spread about the McStays.

Of course, he was having an affair and they were all strangled. Shades of Family Killer, Chris Coleman.

We have a little Chase action too – backing up his truck to the garage and loading up tools (more like bodies). Caught on neighbors video.

And he also uses a Neil Entwistle defense – he claims Shannan killed the girls and then he killed her. (Entwistle claims Rachel shot her baby and then herself).

The killer is saying he blacked out about the murder but led the police to her body in the cornfield. Gray Hughes ( I think it is the same one from the McStay case) has a You Tube channel and he maps out the area where she was running and then where her body was found. He talks about the murder. He also has videos that he has put together on some other cases. He did an extensive one on the Jodi Arias crime. I wonder if this Rivera person has killed other women in that area. So, either the owner isn’t being totally truthful or Riveria had some fake ID that allowed him to fool the e-verify system. I don’t know enough about how it works to render a knowledgeable opinion. I worked the 2010 census for a couple of years and all applicants had undergo that background check – it flagged a bunch of people that we had to let go. What if he was here legally? He would likely been living and working in the same place and possibly crossed paths with Mollie Tibbets sooner or later, or some other unfortunate girl. Many are focusing on the fact he was illegal committing murder instead of the person committing murder. One illegal act does not lead to the other. Neither crimes are connected. It makes me sick this poor woman is being used as a political football.

She is young enough to not remember her killer dad. He admitted to the killing. This is just heartbreaking. The Tibbetts family are suffering where they do not believe they will ever have any kind of normal. They need to go to counseling. Everyone goes through loss of their people and you have to decide to move on from the tragedy and not let it dictate your life or just succumb to the grief and then it is another productive life that is lost. It is difficult but it really is the best thing for you. Acceptance of the tragedy.

They lived across the street from each other. The 53 yr. old guy pushed the 55 yr. old guy and he fell in the street and hit his head. He died two days later from brain trauma. The man was charged and jailed and is now out on bail. His house is up for sale. They have had restraining orders issued against each other through the years. That place has a dark cloud over it, IMO.

    • What station is it going to be televised on? I have not heard anything from the San Diego stations. More info would be good. Unfortunately Patrick’s Go Fund Me is not anywhere near the money he needs. Where are all these Facebook followers of his that bashed everyone that didn’t agree with all that rhetoric crap? Where is Baker who needs to give the whole $15,000 that Patrick is asking for? This case proved to be such an amusement for so many people and now why aren’t they opening up their wallets to help out this grieving dad? This whole case is so perplexing. Truly sad.

Unbelievable about internet people and they are not true friends. Just a presence. Those women ridiculed people on Patrick’s behalf. Where are they now? Hey, $25 would make it happen for Patrick requesting $1500. Just a complete joke. They were entertained by this case for many years. This makes me angry and unhappy for Patrick because he entertained these hags for years.

Jury selection starts with a couple of hundred potential jurors coming into the courthouse each work day over the next two weeks to go through the application screening process until a panel is seated.
The lawyers are not expected to give their opening statements until January. The trial, including deliberations, may last an estimated four to six months.

Do I understand this correctly? They are going to pick a jury now then come back in January to proceed.
Is anyone going to the trial from here. I live a few miles from the court may try to go a day or two.

But like Molly Tibbits it was just a very bad man who killed a 13 year old two years later. I lived in Tucson in 2012 and Isabel case really got to me. Glad they found her killer. Interesting article on this

    • Well Nancy Grace suspects everyone. So many – myself included – are quick to judge someone by the words they choose, way they act, or even where they live and convict them without an ounce of proof. I think back to interviews Mike Mcstay gave early on and people suspected him of something simply because of the awkward way he carried himself on tv. Skeptics believed Summer Mcstay was connected to Colombian drug lords because of her native heritage or that Joseph was a drug dealer getting shipments from Mexico in fountains. All the while they lay dead beneath a couple feet of desert soil from the hands of a callous and selfish human named Charles Ray Merritt.

      • corn, you are speaking as if it is a foregone conclusion that merritt did this. Do you know something we don’t or have tangible evidence ? with all the things coming out in old cases and the amount of innocent people getting released after years in jail, the innocence project and such… i just cant make such a declaration with as much conviction as you.

        • I conclude he did it, from evidence posted here and elsewhere. I’ve done enough research and interviews with those close to him to make that conclusion as well. But I’m not an investigator or journalist, so take what I say with a grain of salt. Of course there are many who have been convicted under tainted or false evidence, that doesn’t appear to be the case here.

Here is one piece from the state’s case: Merritt called Quickbooks on his own phone posing as Joseph Mcstay to request that they delete the account. This after Chase produced and cashed checks in thousands of dollars made out to himself. This doesn’t come off as legitimate actions of a concerned friend that is missing. Does this mean he murdered the family? No, but when put in the grand totality of so many other things Chase was doing before and after, it’s hard to ignore.

Tell about the internet presence this case took with all the blogs and the mud slinging. Correlated with the outcome of the trial and what happens, it would be a very interesting read. This is my opinion but this case is so much more than just a crime story. Just the abuse that Michael McStay took is unbelievable. He is the brother to the deceased and in ways his character was slaughtered also.

  35. I want to amend a statement I made regarding what Patrick McStay had made about the trial being televised. It has been brought to my attention that perhaps I read into it a little too much and I want clear it up. Here is his statement in full below which he posted on his FB page Search4McStays with the portion about being televised in bold:

Alright here is what I know. In today’s hearing it was ordered that the defense and prosecution over the next two weeks will summit in writing a list of questions for the jury pool. This will then be reviewed by both sides. From those (I will call questionnaires) the jury pool will be narrowed to a pool that will be ordered to appear on December 3rd or 7th, 2018 for questioning and the jury will be selected from that pool (I hope that’s explained clear enough).
Those chosen for the jury will then be ordered to appear on January 7, 2019 for Opening Statements in the case.
Now many of you have been following and asking about the trial being televised and motions submitted to the court by many (I can’t tell you who all but it was substantial) for the right to televise the trial. Unknown to the public Judge Smith ruled in last Friday’s Hearing (Oct. 26th), he ruled that the hearing today could be filmed but that for each and every hearing the media would have to submit a motion on an individual basis for each hearing.
So now we wait till December to determine the jurors and alternate jurors that will be selected.
This will now give me time to raise the necessary funds for attending the trial. To save expenses and because there is no real reason to attend the jury selection, I will not attend the December Jury Selection. But you can bet I’ll be there for the “Opening Statements.”

So for now, hearings, not the actual trial. But it’s not a stretch of the mind to accept a strong possibility they are petitioning, and may be granted, to film the trial. Fingers crossed.

I figured he was the quickest conduit to detectives and they should know about and see the video. He left the two FB groups he had and I don’t believe he’s commented there since early 2015. He’s now remarried and assumedly moved on with his life. To me he’s just an ordinary guy thrust into the center of a personal horrific tragedy and prefers his privacy.

Susan has always been closely guarded and I don’t believe she ever commented anywhere other than in the media. I did have the unique opportunity meet her once, very nice lady but understandably a bit reserved.

Is it possible that the dna found on objects in the grave was transferred to those objects from whatever container the bodies of S and the boys were transported in? If there was dna in a tote or laundry hamper could it have rubbed off ? I’m curious about fibers paint and possible fingerprints found on tape…

They believe in the judicial process, not necessarily the innocence of the client. After hearing the pre trial testimony, (which was just a peek at the District Attorneys evidence “, I think Chase killed this family with money as the motive. Jealously, revenge and financial gain are the three motives for murder. First thing they teach in criminal justice.

If someone helped Merritt with this crime, they must not have ever been arrested previously. Does that make sense or am I mistaken?

    • Also, I have never heard if this could be true, but maybe Summer had some help with the housework and cleaning. Someone who did some laundry for her. It would be nice to know what other items had this different DNA other then her bra. Was it clothing? Is it the same DNA found on all the other items in both graves? This just brings more questions. Summer was trying to work the real estate market and was home all day with the boys. It is not unreasonable that she might have had someone come into the home once a week for cleaning the home and laundry. Many people do this out here. It can cost $50-$100 per week.

We have numerous illegals living here. They do mainly landscaping and house cleaning chores. They advertise by printing out a business card, one side in English, other side in Spanish, seal it in a baggie with some rocks inside and throw it in our driveways. I have not seen any of this for the past year but it was life in So Cal for years. These people just wanted work. You could also hire men for $10 an hour for house moving or any kind of chores. They would congregate on a corner and you could pull up and hire them to help you. They never asked any questions.

You making all those calls and talking with LE was amazing. I am always grateful for your help with that unsolved case. Even two of his kids commented on your blog and his son called me. And they are a targeted for obvious reasons. At least the ones abducted. It shouldn’t matter what your class, race, gender, sexual identity or occupation, they all deserve equal attention. Probably the largest ignored category of missing persons is men. I’ve talked to a popular podcaster about this very thing and she tries to cover missing men as much as women that are missing.

With technology advancing as it has, especially in the last decade, it is becoming increasing difficult for perps to get away with these crimes. There is the recent case of Hania Aguilar who disappeared from Lumberton, NC and later found deceased. Her killer was found through DNA left behind and his was already in the system.

I might be contacting that detective again this weekend about Jim.

  40. Reporter in court tweet thread.

The search warrant was to obtain a DNA swab from Merritt’s brother Bennett, leading to speculation that prosecutors believe that Bennett had a role in the 2010 slaying of the McStay family in San Diego County.

The attorneys for Charles “Chase” Merritt want the declaration – which lays out the prosecutors’ case – unsealed Friday because the trial is scheduled to begin Monday.

I find the Bennett info interesting as I thought for a long time his motorcycle gangster son knew something or was involved.

    • It’s very troubling. This is obviously due to the recent DNA found by the defense. I’ve been saying it was a strong possibility Chase had assistance but the DA contended he acted alone. So what else did they miss? I want everyone involved to be held accounted for.

  41. Going out on a limb here. They obtained the DNA swab from Bennett. You can’t do that without a warrant. You can’t get a warrant without supporting evidence. The warrant was executed on December 20th, after the results were made known. There’s only one conclusion to be made from this – the DNA sequence came back as someone blood related to Chase.

The defense presented some interesting views. The fact that eggs and coffee were found on the counter were used to indicate that the murders occurred the following day since attorney claims murder occurred around breakfast. They also claim that Merritts truck was not the one that triggered neighbors security camera. Defense states no blood in home means crime did not occur there. Defense attorney described lack of blood evidence in Merritts truck (did not mention analysis done years later unless I missed it). Claimed cell phone records disputed prosecutions triangulations. Presented testimony indicating 2 separate trucks at grave site. And they played up the best friends bit, so best that they were partners and Merritt was no stranger to Quik Books.

I was not impressed with that first defense attorney and his delivery. He seemed like an amateur to me. Maybe I have watched too many Dateline and 48 hours shows. That guy had a bad delivery. But my burning question is why did he so freely begin pulling money from EIP so early on during the disappearance? It would seem like like he knew they weren’t coming back. Lucky guess? Prior knowledge? Would we know if he was granted immunity? Guess we’ll have to wait and see.

I actually saw the prosecutor do it to Mike again after he was cross examined so that was last thing jurors saw. They know he is very emotional and they are playing on that because they are not allowed to use pictures and other things. I feel very sorry for Mike but it is a good strategy. It showed that Chase had been in the home before they were declared missing.

Weird that he would have him call and not himself, unless he was calling other people at the time. He did state that he didn’t remember him being inside the home, just that he opened the sliding glass door for him to come in. Mike seemed to not recall a lot of things though, like about when Merritt left or that he met Chase at the gas station. That last part I would think he would remember.

Maybe this is what severe trauma can do to your memory. Maybe it is a natural thing. I do think the prosecutors should have made sure Susan and Mike reviewed the police reports and transcripts that they were involved with before taking the stand. I guess the memory loss could also be due to nervousness contributed to the trial and the whole situation.

Only the child would carry his bag if he thought he was going somewhere 😦

The futon cover was missing. The lamp in the upstairs bedroom was knocked over. One of the bathroom rugs was missing. Wasn’t one of the two bathrobes in the master bath missing? Clothes and other items were strewn all over the place upstairs (McGyver thought that was odd). The lamp on Joey’s desk near the window that was left cracked was knocked over. The victims had no shoes on. They had no coats or windbreakers on and it was cool that night. Blue painter’s tape was found in and or near the graves. The sledge hammer had paint that was matched to paint in the home. Then there was the drop of paint that fell horizontally onto her bra.

He also states there was no evidence of a “crime” happening in the home or the garage, after he had to go back in and “sweep” the garage because he forgot the first time (how does that even happen), no blood or bodies and no smells paint or otherwise. so the question is why would homicide then be called? Jackson said it just seemed ‘off’ to him. really? also just my observation here…. does anyone else think it is odd that outdoor play equipment was in the upstairs bedrooms? in one of the pix there is a covered outdoor sandbox and of course the outdoor play houses. Also does anyone think its weird that they all slept in the same room with the play toys? all 4 of them? so strange to me…. it was awful big house to be mostly sequestered into one room. Also as for the lamp in Joe’s office that was upright and on, I think it was discussed in opening remarks.

  50. I would think that Dan Kavanaugh will take the stand. He will tell how Joey was thinking of firing Chase. Maybe he did fire him and that is why he had the loose key for the storage area in his pocket in the grave. Another thing that points the finger at Chase is that he opened up a bag of dog food in the shed for the dogs. If the family left for a vacation or for a few days, they could have had a dog sitter at the house or tending to the dogs. Chase knew they did not leave. He made sure the dogs had food. This trial is just starting so there has to be a lot more to come. I am not sure if Summer was raped. It might have just been staged to look that way to possibly mislead. Truly, I hope, that was the case. My heart breaks for her.

    • Actually what is strange about the keys, going by the pic from opening statements, the two storage or padlock keys are together on one ring with a tag, not separate as where the other keys are not on a ring. So did joseph have them on him with the intention of visiting the storage unit? I couldn’t see him traveling with those all the time.

DK will definitely take the stand. But I see that he will be a very bad witness for the prosecution and the defense will rake him over the coals. We know from the one interview with the reporter that he can be pretty cocky and mouthy, I don’t think it will take much for the defense to set and maybe corner him in several damaging accusations that he won’t be able to explain. I almost want to be there just to see it. It should make for some riveting testimony.

  51. hello I’m just reviewing some of the comments on this page and you said Mike released money to Dan Kavanaugh

“Mike released that money to DK, and according to DK’s interview the monies was going to “vendors and welders”. But when you boil it down, no one had any business being in the accounts. There was no obligation to complete any orders or finish jobs with the company’s owner missing”

So Mike released monet to Dan as soon as the 6th? Before anyone knew they were missing?
