Here, Merritt also is shaking his head. People don’t shake their head if they are in agreement with you.They will do it if they don’t believe what they are telling.

Maybe because there was no call for Merritt to decide not to take.

Merritt: I have absolutely no clue.

This is probably the most telling moment that indicates Merritt knows more than he is saying. Merritt has a long, almost awkward pause before answering. This is a common trait for people when lying. They think about answering the question.

Merritt, pauses, looks away and down, thinking and then raises back up to look at Kaye but doesn’t really look at her. Instead he blinks repeatedly through his answer, also a common trait of deceptiveness.

Why would he need time to think about that when the family had been missing  for 4 years at that point? It should have been a quick “I have absolutely no clue”. Also the use of “Absolutely” is curious as it is a defensive clause. Why not “No idea” or “Wish I knew”?

Merritt’s voice, already reserved, drops in tone to a barely audible end, another show of deceptiveness.

This is where the real Chase Merritt seems reveals himself. His face lights up as he holds Summer in contempt. It’s almost as if he is reminiscing about killing her “She deserved just what she got”.

Merritt: Honestly? [Chuckles] I thought she was egotistical and she thought her _ didn’t stink.

What a nice thing to say about your Best Friend’s murdered wife.

Merritt: Exactly what time, I’m, I don’t remember. I mean I wish I did but, um, it was just, you know, fairly blurry.

Blinks repeatedly and stumbles through answering. Merritt’s tone again lowers to an almost whisper, finishing off his answer with a nervous chuckle, as though thinking I blew that answer. But again, Merritt has had 4 years to think about the last day he saw his “best friend” and business associate. The typical person would go back and retrace every minute up to the last time they saw them. But he also blinks through his now famous statement “I was definitely the last person who saw him”. This is probably one of the few times Merritt is nodding through the statement.

Kaye: Chase says he tried to reach Joseph the next morning.

Merritt: I left a few messages and then the voicemail ended up being full. I got really concerned.

Chase started getting worried the next day after he didn’t get a response back from Joey“.

“Three or four days went by and I tried to call Joseph several times but could not get ahold of him”. – Chase Merritt, Dailymail, Nov 2013

So which is it? Was is the next day? 3 or 4 days? Voicemails?

Chase did call McStay 3 times on February 5.

Subsequent investigating by SBSD revealed that Merritt never left messages. Not one.

Kaye: Finally 8 days after anyone had heard from Joseph, Michael McStay went to his brother’s house with Chase, who knew exactly how to get inside the locked home.

Merritt: Joey had very serious allergies, so he always kept his window open, always.

Very ominous statement. For one, people with allergies will close all their windows up, not leave them open. Second, all reports say that the window was found by Michael McStay and he ‘broke in’ to the house. Nothing about the window being wide open. If Merritt was there earlier in the week (on the 9th) and he fed the dogs, he would have saw the open window. With the recent rains that weekend, wouldn’t he have the forethought to close it if were wide open?

Did Merritt lead Mike right to the window?

But it seems that Merritt was offering a bit too much information, which is always typical of someone trying sell a story. Always.

Merritt told Mike that he didn’t want to be the one to break in because he had a “History”. Nice info to find out from someone you just met who also happens to be a business associate of your brother who is missing. According to testimony at the preliminary hearing, once inside Chase didn’t touch anything and insisted on remaining downstairs.

Here he is again, providing a little too much information:

“Joseph’s family are the ones who lost the most from all this, no question. But financially I lost everything. I was manufacturing all the waterfalls he was selling and I lost my entire business. Without his sales, I had nothing. I went bankrupt very soon after he disappeared, It killed me financially. I even split up with the mother of my three kids because of the stress.”

True, in hindsight, Merritt had already lost everything and had nothing if we consider that Joseph caught onto Chase trying to defraud him.

Here Merritt covers his mouth as his voice changes to a brief high pitch as he makes a comment about Summer possibly poisoning Joseph.

Here is Merritt just after Kaye asks him a follow up question. There is one thing that interviewers know, when a person looks up or down before answering, they are searching for an answer (lie) to give. Also notice the placement of Merritt’s arm and hand. Some people will place an object between them and the other person as a sort of barrier. Chase has his legs open as if to show he’s comfortable but he’s not. He is protecting his assets so-to-speak. Notice also the fingers outstretched. A sign of anxiety perhaps.

There is also something about the hat. Who wears a hat to an interview? With CNN even. It’s really bugging me and I have thought about it a lot since the interview.

The only conclusion I can come to is: Dominance. He wanted to be the rugged guy but once Randi Kaye got to talking to him, he wasn’t rugged and ‘tough’ after all. He disarmed her from the beginning. Putty in his hands.

One thing is for certain though, Chase Merritt was really adamant to get Mike McStay out to the house. I wonder if he was wearing the hat then.

A true low point has been reached on Jim Jones Baker’s blog. It is so depressing. No victim spared. It’s like the triumph of evil over good. Does it drag you down too? Sigh…

    • Great post, Colonel! Thank you! The Randi Kaye interview was one of the first things I watch when I got interested in this case. That was back in January of this year and I was so haunted by Merritt’s demeanor and his words, I knew something was off. So I started reading the McStay case at WS and was truly amazed to see that all most people wanted to discuss was Mike McStay, Susan Blake, and Dan K. Over and over again. It was so confusing. That seems so long ago now. So much has happened in this convoluted case since then and there’s still so much more to go.

      So what’s with Baker’s claim that Joey was scrambling to collect $80,000 by 2/4/2010 because EIP was a front for some illegal shenanigans? Basically Baker is trying to turn Joey into Merritt who actually did scramble and scam for money to pay off gambling debts. Got it. So whose going to testify in court about EIP being a front for some illicit activity? The money launderers, bookies or drug dealers? If not them then Merritt will have to testify, right? It’s so ridiculous. That post was made by Baker simply to stir up the mites. They jumped right in and are back to crucifying MM, SB, DK and everybody but the accused!

    While Chase was ..cough..borrowing rent money the McStays were also in debt to a home money lending cartel South of the Border.
    These cartel loan scammers just happened to decide to whack a family of 4, 2 of whom could barely talk, on the same day Chase was stealing and forging checks from the McStays.

    • Chase did not kill this family. Who bludgeons a family for $30K? $30 million, yea. But he DOES know who did. And very well may have buried them. They were ALL shady, JM and SM included. EIP was a front. How can a puny internet fountain company go up against tons of already-established brick and mortar fountain companies (google “fountain companies in San Diego County alone) and turn the kind of profit Kavanaugh said it did. And I suppose there’s a shortage of fountain companies in Saudi? Probably the fountain capital of the world? Has anyone ever seen an eip fountain installation? I mean one that can be proven to be an eip fountain? Pictures on a website or youtube don’t count. They could be pictures taken from anywhere. And the “how-to-use” video of Chase on youtube could have been for a fountain from ages ago when he was working by himself.

      I don’t know anything about cartels and am not saying it was a cartel. But it was a hit and everyone knows cartels don’t kill kindly. It is perfectly conceivable that the murderers broke JM’s leg, immobilizing him, and forced him to watch his loved ones slowly die blow-by-blow before they whacked him. They are perverse like that. It is a horrific thing to have to realize and I believe it was Ramos who said they suffered substantially. Even without my theory, Chase could not kill children, let alone kill them slowly.

        I can tell you who doesn’t bludgeon entire families for $30k, and that would be cartels. That isn’t even lunch money for them. Why make it seem as if they had disappeared if this was a “hit” as you claim? That makes no sense at all. A true hit generally sends a message for others…..there was no message here, there was an obliteration of an entire family, and then a cover up to give someone plenty of time to take what was needed and escape detection.

      • I live in San Diego and happen to know for an absolute FACT, that there are NOT “tons of already established brick and mortar…” Four years ago, my neighbor gave me a cast concrete wall fountain and I searched high and low, for a company to find out how to care for it, to no avail.I finally contacted the manufacturer UP IN THE BAY AREA. For another thing, I have NEVER heard of a drug cartel killing anyone IN THE U.S. I strongly believe, if any such thing ever occurred, that it would become an international incident.
        There’s only ONE person capable of brutally killing the McStays and he is currently on trial. Maybe the San Diego Sheriff Dept. is stupid (*I* suspected CM, from the start). But the San Bernadino one is NOT.

    something more sinister perhaps. I often thought early on it was a cartel related crime but everyone jumped all over this as being false. I remember some of the real estate scams were abound. People would get a loan from an undisclosed source and deposit in their banks in order to qualify for a house. they could then flip the house and make enough money to pay for the loan and have money left over. California real estate was nuts up until 2008. Then the bottom fell out. Lots of people got screwed. I believe this is maybe what tripped up Joey and Summer.
    families are usually not bludgeoned to death over U.S. lending institutions. Did they go south of the boarder to find financing?

  6. In regards to chases hat, what really gave me the willies was on the Tim Miller part 1 video, @ 1.30min there is a shot of a cowboy hat hanging on a stroller. It may mean nothing but it’s seemed really Eerie to me.

  7. There’s a few statements I disagree with in the post.
    Looking up and down is a signal that someone is thinking, they may be retrieving information from memory, or thinking about the future. Or coming up with a creative lie. Of course we know merritt was lieing.
    Merritt says he fabricated the fountains and Joey bought the fountains from him. I think that was true for a while, but Merritt’s growing debt must have meant that Joey was no longer purchasing the fountains, rather the fountains merritt fabricated were applied to paying off the debt owed to Joey. And that obviously wasn’t going very well because the debt Merritt owed kept increasing.
    Merritt was lieing about the debt and his financial arrangement with Joey in Feb 2010. You can see the way he squints his right eye as he says ..”and Joey bought the fountains from me”
    I also disagree that Randi Kaye was in anyway fooled by Merritt. Her steely eyed, tight lipped expression, when Merritt talks about Summer and how “Joey loved her to death” says it all. I know she comments to her fellow CNN workmates that no red flags were raised during her interview with him. But really, what else could she say? It’s her job to put potential criminals and victims at ease while she interviews them. And boy, did she deliver! I’m also fairly certain she was briefed by LE prior to the interview, and that her list of questions also included some of LEs questions for him.
    I hope at some point we will be able to see more of the two hour interview. Great post CW. Thanks

    • I agree, sometimes when the eye moves to the left or right it recalling memory. Or it could be recalling the truth but speaking something entirely differently. The “I have absolutely no idea” comment about what happened to them is telling, IMO.

      One thing that should come back to bite him if he tries to throw other people under the bus, is he said he could only think it was random because he can’t think of anyone they knew that would do this.

      • He goes from not even being able to remember Summer’s name in Feb 2010, to supposedly knowing all about J and S private family life and marriage after the graves were found. I’m curious about just how well he really knew the family outside of Joey, probably not very well at all. Did him and Joey even go paintballing more than that one time?
        He probably just made up stories based on talking with Susan and Mike and reading “the book”.

      • He said that would want to hurt Joseph. Just like his statements about Mexico, he said it was not Joseph’s walk and Joseph would not take his children to Mexico. We also do not know what he really said to LE. We have his word. He is all over the place and gives so much B.S about why it would not be him. But he also gives information about Summer that is really uncalled for. He might have been attempting to allude to the idea that if anyone was a target it would be her. Bringing up other factors I will not repeat that could lead people in another direction. But his was not able to contain himself. He goes to far and it becomes somewhat obvious he has some real issues. His goal in speaking after being silent all these years was to help solve the crime. At least he achieved his goal.

    And it appears someone brought up (and it wasn’t me) Walter Merritt & his Vagos connection. One thing they didn’t post, which I don’t think I mentioned since I don’t want to sound like a conspiracy nut…is that Walter was picked up by the police in August 2014 but never charged with anything or held. Even though he had outstanding warrants in SB county. Since I didn’t see anything in the SWs alluding to Walter, it is probably the rabbit hole I thought it was.

    • Existing flooring or carpeting was probably torn out & discarded, buried, burned by the murderer. Cops may have located it. If so, there’s your proof the murders occurred INSIDE the family’s home.

      I don’t know about Mexican cartels but I did know members of Medellin & others. $80k is chump change, especially for an established middleman/dealer as Joey would presumably be if EIP was a front for criminal activity. It’s not worth butchering four people & HIDING the bodies over that amount. They don’t murder people who get busted & drugs confiscated (unless they snitch) or when a shipment gets intercepted by border authorities or plane drops bales in wrong spot & it washes up on beaches, FYI.)

      These guys make their murders very public to send a message to others who might think about ripping them off or ratting them out.

I have to be careful as we are getting into an area, an industry, of which I am not familiar and to be honest, scares me. I am not about to put my family at risk, so moving forward takes a bit more strategy than I am used to. This whole thing is bigger than what we have all thought. Patience is not one of my virtues to be sure, but I am practicing it now.

He did at one point have some sort of small breed dog…….I have seen pictures of him with the dog, and at one point he did a radio interview about the metal art he was doing at the time, and he mentions the pooch and how it accompanies him everywhere. This was some time well after the disappearance.

  16. I have always wondered about the dogs, particularly Bear. Knowing the bond between Bear and Summer, and that he was at least part Akita from what I understand, makes me wonder if he drugged the dogs first.

    I am convinced that if able and in a position to do so, Bear would have fiercely tried to protect his family against harm, and certainly such a vicious attack. Even though he knew Chase and was familiar with him and his apparently frequent presence in the home, he would have reacted to try to keep his family safe. Had the dogs simply been put outside, Bear would have been very vocal and frantic if he sensed what was going on.

    I also wonder if Bear picked up on Summer’s dislike of Chase. It is very probable that he would have. Chase must’ve had a plan to deal with them. The risk of them making an audible fuss that neighbors would have heard was too great. And at well over 100 pounds, the threat of Bear jumping in to defend the family would have been very real.

    • I so agree with this, I had a wonderful German Shephard, someone tried to break into my house, he woke me up, I let him out and he chased the guy, and tore a chunk out of his jeans as he went over the wall. No way were those dogs present., and, or conscious, Bear would have defended his family.

    • I’ve thought about the problem the dogs would have presented the killer as well.
      Chase mentioned that he opened the shed to give the dogs shelter, that would be the first time he went to check out the house.
      I’ve always thought that perhaps it was the night of the murders that he opened the shed and lured the dogs into it with steaks laced with drugs. Maybe he did want the dogs dead but didn’t use enough drugs?

      • So Chase may have arrived at the house and surveyed the home from the darkness of the backyard, before ambushing the family. Lock the dogs in the shed with ketamine laced steak, enter through the sliding glass door. Joey may have been sitting on the futon watching TV, or in his office.
        Hopefully LE will outline their theory during the trial.

        Chase knew and liked those dogs, Chase likes dogs, he couldn’t kill them because of those 2 reasons.
        You hear all the time about dogs being shot in random crimes.

        This is something I too have thought about a lot and it is one more finger pointed at acquaintance, not stranger.

    • I don’t think he drugged them. I think they were outside for whatever reason and they didn’t make a lot of noise because they knew Chase.
      I think that would be complicated, get doses for Bear and get them to eat it and wait.
      I mean it is possible but I think the dogs just know Chase.

    That has been the number bantered about in Tijuana. Cannot confirm yet, but we will see. I will be down there later this month. It is then that I will decide if I am going to pursue this further. Maybe we should all get together for coffee somewhere halfway between SD and SB?

  19. Ya know Baker says he doesn’t drink but I seriously am doubting it the last couple of days. He and his minions have lost all sense of reality. What’s super scary is they are taking themselves and each other seriously! Do they not know how ridiculous they sound? I’d like to think they’ll wake up in the morning with a serious hangover and look at the posts and think WTF? I’m afraid tomorrow is going to be more of the same rabbit hole of lunacy.     So does anyone actually believe that Rick Baker or anyone else fabricated those things about Dan K: the email from Joey to his web search placement service, and the instant message conversation between Dan K and Joey?

    The CBS interviewer even alluded to Dan K’s threats during that doorstep interview at Dan’s apartment. The only response that Dan could come up with was a lame “taco shop scenario” which the interviewer obviously wasn’t buying.

    Just like nobody was buying Dan’s claim, during the CNN interview, that he and Joey had “a little bit of a gentlemen’s agreement” regarding 50/50 ownership of EIP. Patrick Mcstay, Joseph’s own father, apparently didn’t even know who Dan was when he called him in early February. When Dan sold the company in 2011, Patrick was furious and claimed that Dan had no ownership of EIP whatsoever. Are we to believe that Patrick Mcstay is lying about that?

    And furthermore: are we supposed to believe that CBS and CNN are in cahoots with Rick Baker to destroy Dan K’s image. Is that it? Really??!

        He may very well be laying low before the trial, which is not only completely understandable, but appropriate. And I’m sure that LE and/or the prosecution advised him as such.

    • I think that DK will turn out to be a solid witness for prosecution. It is pretty clear that Joey confided in him re: his problems with Merritt. I would bet Joey cut Merritt off that day and told him he would have to pay all the money back.

This case is actually not that widely known at all. It is simply not true that it is being discussed at the levels Baker is claiming, and you notice the media coverage other than the not recently aired CNN special(s) is neither national or prevalent. Baker is FOS, as usual.

    And the utter ridiculousness of Baker’s claims that he is the one that will “solve” this case with his little book are simply laughable.

With the amount of press that was at the prelim I was surprised at how quickly the story got put on the bottom of the news. People seem to care more about stupid celebrity’s (Bruce Jenner???) than they do about an entire family that was murdered. It is extremely sad and disappointing.

    I finally was able to update the “report”. (It’s not really a blog, just a quick reference I’m using for what I am doing, and thought it might be useful to others.)

    The “report” includes the warrants–broken down so that people can look at them individually. When I did this I discovered that of the 33 warrants released–1 was duplicated. There were warrants listed in the DA’s motion, that were not released (this is beyond the two warrants we were told would not be released). And warrants not mentioned before, that were released.

    Don’t know what that means. But is is curious.

    I have not had a chance to update the Prelim info.

Only one person used Joey’s debit card at the casino. The look on Merritt’s face as he withdraws cash from the casino ATM, using his dead associate’s debit card will undoubtedly haunt the jury. (Talk about stupid – a casino is about the worst possible place to have done that. They record & store tremendous amounts of footage to detect and blacklist card counters and the like.)

    While the purported vanishing Instagrams, FB posts, LinkedIn accounts, and completely irrelevant (if not imaginary) corporations and websites Rick Baker & Friends post may be interesting distractions for his fans, a jury would see nothing to exonerate Merritt. (And that would be one heck of a legal hat trick if the defense somehow managed to get that junk admitted into evidence.)

    I don’t believe for one minute Mettias and his co-counsel will use a single thing offered up by Rick Baker and his menagerie of misfits. Any followers still commenting there (who aren’t Rick’s alter-egos) are essentially trying to make sense out of a sadistic madman’s ramblings or messages divined from a ouija board. Their time would be just as effectively spent using Geiger counters and kaleidoscopes to look for ghosts.

  51. I live on the east coast. The only coverage I’ve seen about this case in the past year or two was the CNN specials. CNN doesn’t report updates on the case that I’ve seen. Nothing about the preliminary hearing, announcement of death penalty decision, search warrants or anything, at least when I’ve been tuned in. Anyone else see it on national broadcast or cable news since CM’s arrest?

    Twitter only shows 1 person mentioning McStay in the past 24 hours when I searched the McStay name or hash tag. I don’t know how you search FB for discussions so I can’t comment on that.

    Does anybody over there verify any of RB’s “facts?”

    So the DNA results which led to his phone records kick started the trail to Merritt. Too bad, San Diego or the FBI didn’t test the DNA from the car. Since neither agency ever hauled him back in to discuss his DNA being on the steering wheel etc, he must have thought he was in the clear.

    I wonder what LE was doing between the Feb warrant for Chase’s phone and the July warrants for the other numbers tied to Jarvis.

      I think there are many more warrants served than what we have been given–or made aware of.

      The warrant-bundle that was given to the public was not 33 warrants, but 32 (SBSW 14-1096 is there twice in the bundle). So only 32 warrants were released.

      There are the two CPS related warrants that were kept back. But the DA gave Kelly Aviles a list of 35 warrants they wanted sealed—even deducting the two CPS warrants, there are at least 4 other warrants on that list that were not released.

      And if you read the warrants we were given, carefully, there is mention made of two additional warrants, that were also not released.

      In total, I identified about 6 warrants not released (and again, that’s not counting the CPS warrants, that is in addition to)

      The strange part is warrants not previously listed by the DA were released. It’s a big ole clerical mess.

      I’m looking into it.

They want me to blow up Mike and all the other people involved in this case but when I go near Cathy they freak? She is a legitimate person to know more about. She changed her statement on the phone call, burning Chase’s alibi and she posted an odd comment to her FB almost three months after Joey disappears? Three months? That alone demands further investigation. Sorry sibs, it is what it is: fair.

I know it’s a common expression to some people, but I have never said it myself about children, or anyone, and I just think it’s weird how murder is thrown around as a joke. Then he becomes the primary suspect in a murder investigation. What else can she do but cooperate with the police and DA? Does she even have other options?

  62. Maeve – Looking at the search warrant list- 1294 (West) is more than likely another phone number warrant or pen trap trace. This is from Baker’s rants-“LE is still tapping Chase’s girlfriend’s phone, someone who was not even in the picture five years ago.”

    What I find intriguing are all the missing warrants signed by Judge Pace and the timing of them.

      I’m not sure what to make of the way in which the warrants were handed over. At one point the DA confirmed there were only 35 warrants. Now it looks as if there are at least 40 in total.

      We have seen 32. And there are the 2 warrants we won’t ever see for good reason. So what about the other 5 warrants?

      I also find it strange that we would suddenly be given warrants not on the DA’s confirmed list.

      Again, not at all sure what it means.

      It’s confusing if nothing else.

      And then there’s the fact we were initially told there were 60.

            No. I don’t think so. The scope of a warrant is pretty narrow. We don’t get to see the results, anyway.

            What I really think is that this was a complicated investigation. The files may have been in many different locations, and that there was a clerical error.

            Otherwise I think we would have been told: “These warrants can be released, these others cannot. And why.”

            I am surprised media hasn’t discovered this. But maybe they don’t care. They have seen enough of the case to write their stories.

            If the discrepancy is relevant, it will be raised by the defense. Or someone.

            If not. Those of us who are curious will just have to find a way to get copies of those other warrants.

            • There is the pre-trial hearing on Friday. The media attorney said she was going to argue about the redactions right before they were unsealed. If she still plans on arguing that before the judge maybe she’ll bring up the missing warrants.

          Probably means nothing. But it would be interesting to get everything. (Obviously excluding those warrants that might be harmful to someone innocent, and not actually relevant to the case.)

Then again in 2011, she asks her Facebook friends to write a eulogy for her and requests they send it to her address, a po box.

It seems like her child is in commercials? 3 letters in his name? It appears she doesn’t really raise him, as she is never the one at these events with him, but someone else is. It’s odd. So she comes back from flagstaff and is doing steel art with Chase. Who knows, what a life.

    • I can assure you, with some conversations with her, she is not odd. Cathy is very ordinary. I don’t believe it’s fair to judge someone based on some FB postings about their morals, like helping to hide a body. Someone found the very same post on Dan’s Mom’s page a while back. It’s not to be meant to be taken seriously.

      I also have concern about people judging her about posting on FB regarding the disappearance of the family as late as April 2010. It seems at the time she was very new to FB (her first post was at the end of 2009) so to me there are some considerations that should be factored. I’m thinking she didn’t frequent FB that much.

It seems like RB is throwing anyone he can under the bus to push his agenda. He says he’s working on his book and will reveal all kinds of revelations soon. NOT. He’s been wrong every single time. I think more his agenda is about getting hits to his blog and drumming up interest for his upcoming book. He doesn’t care about the family and I think the Merritts are starting to see about RB what everyone warned him about.

      • I agree that some read more into social media posts than is there, but the DA (or police, I can’t recall) did get a warrant for their Facebook account information. I wonder how that will come into play at trial, if it is used.

          If you look closely at the warrant related to the FB search (SBSW 14-1848), what LE appears to have been after was the “messaging” between parties on FB, not the posts.

          In the probable cause portion they mention that FB allows you to message, similar to texting, only the messages won’t show up on a phone log. You have to access the FB account to see the messages. That’s basically what the warrant is for–to search the messages.

          LE states a number of times in the probable cause affadavits that they are examining ways in which Chase may have communicated wtih others, without leaving evidence in his phone records.

            It’s astounding how much we give away, just to utilize that service.

              FB also collects your geo-location & ISP info even if you make it private on your account. It isn’t viewable by the public or your “Friends,” but FB has it. I am uncomfortable using FB Messenger. No way will I answer an incoming call made via Facebook. Their privacy notice and TOS are insanely long and regrettably, no one, including me, reads it. (Or could understand it, even if they did.)

              I’m surprised there is no warrant for Google account information. (But did I read he used a library on occasion to go online?)

              Remember the hooker who is accused of murdering the Silicon Valley executive with an overdose of heroin? She had some very incriminating Google searches. (He may have even been a Google exec, I can’t remember.) In the Erin Corwin murder, her alleged murderer searched for “how to hide a body” and abandoned mine info, IIRC.

              The internet and social media have their benefits, but 20, 30 years ago, can you imagine any of us agreeing to hand over all of that personal information to ANYBODY? Even when the Patriot Act was first passed, librarians (and citizens like myself) were outraged the government could demand to see which books a patron had ever checked out.

              I’d be a little embarassed now to have all of my online activity made public, but I don’t think I’ve done anything online (or off, lol) that would implicate me in a murder or terror plot.

A parent might be there to watch, but they would not be “handling” him unless they are in fact his representation. Parent(s) would be relegated to the background on a commercial set.

          I am not convinced Cathy is of good character or morals and the majority of that is based on lying about the phone call that they both knew never happened. Well, chase likely knew because he called himself, but then for her to make up a lie based off what Merritt told her is wrong. Sorry, I would NOT do it, even for my husband.   69. JMO, but I imagine if I was being asked by detectives about my partners whereabouts on a certain evening I would want to make sure that what I was telling them was correct and from real memory. This would have been a serious conversation between the police and Jarvis and if she couldn’t remember if her partner was by her side that evening watching a movie and ignored an incoming call from JM like she said then she should have indicated this at the time.

    Jeff Hancock has done an interesting study in the language used by psychopathic and non- psychopathic murderers. And is now researching social media and digital communication.

      The SW’s were first loaded into Google Docs. Do you have an account? I don’t think you should need one, but it’s free and it might make a difference.

      I’ll look and see if there is something I can do on my end.

      • One thing I noticed, even for me, is that you have to be patient. The easiest way to ultimately read the docs is to click on the icon farthest to the right. This takes you directly to Google docs and it is easier to read the entire thing.

        Again, I’ll fool with it some more. It works fine for me on a second computer I have that isn’t signed into the acccount. But it does render slow at times.

    • OK. I don’t have an IPad, so I can’t check there. But my “tester” mac, opens everything fine. And the mac I test on is a million years old. So pretty much any computer should be able to open these.

      But I do want to figure this out, because my intention for this originally was so I can open these files when I’m not at home and just want to check something.

      Are you you having trouble entering the site, period? Or just the individual SWs? Or both?

      I’ll do some research.

      I’m going to try opening the site from my phone.

      Please let me know how that works. I was able to access the warrants from my phone, and my phone is an android piece of crap (very old)

      It might have to do with Ipad controls–you might need to allow for something that is currently blocked. Or with IPad sometimes you have to download an app–like Google docs or something.

      Also, it may have something to do with the browser.

      I like that it’s the use of all the little words in our speech and text that provide a window into how we think, because we have the least control over how we use them. And that backspacing is akin to using “um” or stalling in speech.

    • This is also interesting, in relation to Merritt’s talking in his interviews about the pizza story and money. The transcripts were of murderers talking about the murder they committed and the events surrounding the murder.

  78. Just learned about a very eerie coincidence today!

    I was looking at the comments under the Daily Mail interview with Merritt. Somebody commented about a guy from Washington who disappeared during a trip to Vegas in May 2010. A guy named Bill Wheeler. He was a successful entrepreneur, like Joseph Mcstay. He is still missing (presumed dead). His burned out pickup truck was found in late-May 2010 near the intersection of Puma Rd and Quarry Rd, just west of Interstate 15.

    Sound familiar? It’s about a mile north of where the Mcstay family was buried!

    What are the odds? A guy vanishes, nowhere to be found, just months after the Mcstay family mysteriously vanished. His truck is found soon afterward, set ablaze, just a mile from where the Mcstays were buried. Also just west of Interstate 15, a short distance from the freeway, just like the Mcstay gravesite.

    Now, have a look at Google street view on the southbound 15 freeway next to where the truck was found. You’ll notice that there’s a burm running alongside the freeway to the west, and it completely blocks any view of the desert to the west of the freeway. Whoever set the truck ablaze chose a spot that was hidden from view, just like the spot where the Mcstay family was buried.

    And here’s the icing on the cake: in the CNN Special “Chasing A Killer,” Patrick Mcstay was talking about how he’d been in contact with Merritt in May 2010, and how Merritt had then suddenly disappeared. Nobody could track him down for months. I wonder what Merritt was up to during those months.

    So is this just a coincidence, or is Merritt possibly the perp behind the Bill Wheeler disappearance as well?

  79. Baker’s blog is exactly why missing/murder victims’ families should trademark their loved ones’ names and images. People will judge them for it but I get sick to my stomach seeing photos of the McStay tykes accompanying text that slanders and maligns people who actually knew and loved them in real life.

    RB was upset & bitter about his child custody thing, to the point of obsession, as evidenced by his registered domains up to 2012. Just my opinion: For whatever reason, he transferred that obsession to Gianni & Joseph Jr. As a bonus for Rick: they can never disappoint him with their imperfect behaviors as they mature, nor can they ever hurt his feelings by telling him to stay out of their lives.

Regarding the Bill Wheeler disappearance: if he was actually killed in Las Vegas, then why would the killer drive 2.5 hours south to Quarry Rd./Puma Rd. in Victorville to dispose of Wheeler’s truck??? There’s a vast expanse of open desert within an hour of Las Vegas. Why drive 3X further than necessary to dispose of the truck? I’m thinking he must have met his fate on the CA side of the state line. And it’s very interesting how the truck was dumped in a location almost identical to that of the graves: fairly close to the freeway in an area not visible to passing motorists, just off of a seldom-travelled dirt road. Spooky indeed!

    • This is where it’s very dangerous to have an attorney with only a background in civil trials, handling a criminal case—a demurrer based on jurisdiction is only valid in a civil matter—not criminal.

      • I should add, technically you could object on the grounds of jurisdiction, but not in this case. The Superior Court is a court of general jurisdiction, and where more than two jurisdictions share a crime scene(s), one jurisdiction can hand the case over to the other. This was already discussed when SBC took over.

          • I think the judge has to allow for the motion. It’s a “legitimate” motion. Kind of. In fact many cases have been held-back for years, based on these kinds of motions being filed, one after the other.

            And I think you are right, if he doesn’t allow for the motion there is a possibility that it might be used in appeal (not sure how, but possible). This way the issue can’t really be vetted again.

            The jurisdictional demurrer is usually civil. Civil trial is where jurisdiction gets really tricky.

            And this is late in the trial for this–really Mettias should have filed this June 24. But this is a DP case, so every attempt is being made by the court to appear fair.

            The defense is in a tight spot. They came into this thing roaring foul play. And now they have a defendant who it seems is unable to tell anyone where he was during crucial moments in this case. Even though he was writing a book on it!!!!

            OOOOOps!

            I think we all figured there would be a delay. I thought they’d just admit they needed more time. But maybe this way, they save face–for the moment.

      I’m dying to read the motion. When SBC took this case over it was discussed in numerous articles and in televised interviews that jurisdiction was discussed. We don’t really know exactly where the McStays finally died. They were abducted from their San Diego home, and most likely assaulted there–but the lion share of the crime took place in SBC–and two jurisdictions under these circumstances can agree that the entire case will be tried in the other jurisdiction.

      Also, this is the State of California v Merritt.

      It’s not as if this occurred in two different States.

      The only thing I can imagine they might try for is that each aspect of the crime be tried in the jurisdiction in which it was believed to have occurred.

      But again. I can’t see that flying.

      I’m sure the DA thoroughly examined the jurisdictional issues when he filed. This isn’t their first rodeo–but it is Mettias’.

Subject matter jurisdiction is easily decided because criminal courts or the courts of general jurisdiction have automatic subject matter jurisdiction over criminal cases.     Not the defendant (unlike a civil case, where the defendant has more choices)

    Unless a motion for change of venue is made.

  87. Here’s a wacky theory I’ll propose. I don’t think it’s quite up to the certification levels of RB bloggers, so here it goes.

    Suppose Merritt drove around for a day or two, looking for a good spot to dig the graves. When he finally chose the location at Quarry Rd / Stoddard Wells Rd, he was in a hurry or was feeling lazy, so he only dug down about 2 feet.

    Later, after being questioned by San Diego detectives and seemingly being dismissed as a main suspect in the family’s disappearance, he realizes “oh crap, maybe I didn’t dig deep enough” and starts fearing that the graves will be discovered. So he sets his con-man radar to overdrive, and eventually comes across a a solitary urban cowboy (Wheeler) passing through the area, with an expensive looking rig in the back of his pickup. Merritt puts on his friendly cowboy mask once again, gets to talking with Wheeler, and maybe tells Wheeler about a local gentleman’s club, or helps Wheeler repair something that broke on his truck (Merritt somehow gets buddy-buddy with Wheeler). Then, he murders Wheeler at the first opportunity.

    Learning from his past lessons of being caught with stolen goods, he leaves the espresso machine in the pickup. He then parks the pickup about a mile from the Mcstay gravesite and sets it on fire knowing it will be found soon afterward. Merritt figures that, this way, if the Mcstay graves are ever found, the scorched truck nearby would likely be tied to the graves by law enforcement, further deepening the mystery and creating speculation that Wheeler and the Mcstays were somehow connected with shady dealings in Vegas or elsewhere. Maybe Merritt thought this would draw any attention away himself as a possible suspect.

    Next, he buries Wheeler somewhere out in the desert in a deep grave far from any roads, never to be found. The apparent signs of struggle at Wheeler’s vacant rental home in Vegas could have been nothing more than the previous tenants trashing the place. Or, however unlikely, maybe Merritt found the Vegas rental address in Wheeler’s glovebox, drove out there, watched the house for a bit, determined it was vacant, and then went in and staged it to look like a possible crime scene. Again, this would be pretty unlikely, although not totally implausible.

    So if this scenario actually took place, maybe Merritt thought he’d be well prepared for any outcome — whether the Mcstays remained missing, or whether they were eventually found where he buried them.
